What Are Prize Draws and How Are They Organised?

Organising a prize draw is one of the more popular and effective ways to increase sales and promote products and services. Prize draws raise brand visibility, encourage purchases, and strengthen customer loyalty. They are particularly effective when combined with social media campaigns.

However, prize draws are also strictly regulated by the Law on Games of Chance (“Official Gazette of the Republic of Serbia”, Nos. 18/2020 and 94/2024), and prior approval from the Games of Chance Administration is required to organise them. Organising a prize draw without approval or in breach of the applicable regulations can result in substantial fines and damage to the brand’s reputation.

What Qualifies as a Prize Draw?

The defining feature of a prize draw is an element of chance. If the winner is determined randomly, for example through a draw, the proposed promotion qualifies as a prize draw. By contrast, promotional activities that reward knowledge, skill, or creativity according to predetermined criteria may have a different legal status. Before a campaign is launched, we assess the proposed mechanism and determine whether approval is required.
